Infancias marginadas e injusticia estructural : una mirada crítica desde la filosofía del derecho a las medidas de justicia distributiva que previenen el reclutamiento forzado de menores en Colombia

The forced recruitment of minors in Colombia constitutes one of the most serious violations of human rights and international humanitarian law, as it involves the participation of children and adolescents in illegal armed groups through coercion, deception, or other forms of co-optation. Despite the existence of a robust regulatory framework and international commitments made by the State, this practice persists and even increased during 2024. The objective is to identify whether the distributive justice measures implemented in the Colombian legal system are sufficient to prevent this phenomenon. Using a qualitative methodology based on the analysis of documentary sources from the perspective of legal philosophy, the results offer a critical reflection that urges the Colombian State to reorient its efforts towards transforming the structural conditions that perpetuate the vulnerability and exposure of minors to armed actors.
