La familia de crianza en Colombia : Ley 2388 de 2024 y posibles soluciones al vacío legal respecto de la ausencia de consentimiento de los padres de crianza para el reconocimiento de los hijos de crianza
This monograph examines foster families (familia de crianza) in Colombia, progressively recognized by jurisprudence and expressly regulated by Law 2388 of 2024, whose exclusive consent requirement from foster parents creates a legal gap in cases of absence or inability to express it, such as death or disability. It analyzes legislative and jurisprudential construction, the dogmatic-procedural gap, and proposes solutions like reforms and constitutional actions to expand standing and protect principles such as solidarity, pluralism, and equality. It contributes academically to strengthening rights of foster children in non-traditional families based on socio-affective bonds.
